Question Answer?

I'm just trying to figure out if my soon to be ex d-i-l will need to show proof of her SSI as income when it comes to the Child Support issue? Anyone know? I believe my son should help support his daughter, after all, he did help create her, but he only makes $8 while his soon to be ex-wife sits on her butt all day and collects $700 a month in SSI.

i know when i went for child support i had to show ALL means of income...even if i was getting state assistance for medical benefits. All was taken into consideration. Here, a majority of the child support comes from how much you are paying for child care and medical benefits. They also figured out who made more monthly and did some calculations to figure out how much he had to pay. I think it may be different not just in every state, but every county in the state as well

700$ is not a lot of money...esp for a SAHM. I would suggest seeking coucil

I know someone whom would have owed her daughters' father money had child support been an issue because she collects SSI for both girls~no other income. She was granted sole custody as well. His income was lower than hers at the time of the custody trial. But neither wanted money from the other. This was just over 5 years ago in the state of Pennsylvania. To this day they still have not been granted a divorce because of her foul ups with the paperwork.

But to simply answer your question, yes SSI counts as income in custody/child support cases.

i completely agree....your son, even at making $8/hour, if he worked a 40 hour week, his gross income is $1280...almost $600 more then her...and that is almost double what she is getting from SSI...

I'm assuming he makes 8 an hour. Not just $8!!
Does she really sit on her butt, or is she actively raising your grandchild?

Why is she on SSI? Is she disabled?

$700 a month does not carry you very far where I live. Doesn't even touch the rent in much of NJ.

How old is your son?

I agree completely. $700 is nothing, especially when raising a child.

While laws in various states differ in some aspects, they virtually all view the income of the parties as a whole, including SSI. The law allocates a weekly child support amount based on the total income of the mom and dad, then it calculates the ratio, or the percentile that each parent contributes to the whole. For example, if Dad made $1000 a week and Mom made $500 a week, the total would be $1500. Of that amount, Dad makes approximately 66% of the whole, and Mom, 34%. A formula is used to calculate the child support from the whole ($1500.00). Most states have a table that one can use that gives the weekly support for a varying number of children. So, if the support were $200.00 a week, then Dad would pay 66% of the $200.00. The custodial parent is deemed to contribute the remaining amount (it's never actually paid).

In the case of your DIL, her income will be calculated along with the father's income and worked out as outlined above.

Hope that helps, tho it's a bit untimely, I know.
