couple questions.....
hi guys, i'm a new here and have a couple questions. i was searching the internet for some help with some stuff, and this site came up. i tried looking around this site a bit first to make sure the answers werent somewhere else, but didnt see anything. and while i see that there are several other threads dealing with child support in PA, but my question is a bit different....
ok, so basically its like this: my fiancee's parents have been divorced for some time. the mother had custody of all 3 kids and lived in PA while the father moved to Arkansas. apparently, dad did not pay the child support for a while and mom sued for it. dad recently told my fiancee that he had been struggling and couldnt afford to pay it, but mom got about $18,000 out of the settlement. my fiancee only saw about $1,000 of that and never knew how much had actually been granted. dad also told fiancee that he continued to send payments for her a year and a half after she turned 18, about $3,700 extra and again she never saw any of that. we just learned all of all this about a week ago. is there any way my fiancee can sue her mother for all the money that was never given to her or spent on her? the mother has no expenses of her own, as her own father pays for their house, car, health insurance, etc. so we know thats not where the money went. i know parents can sue each other for child support, but can a child sue their parent?
my second question, as if the first one wasnt confusing enough, lol, is about health insurance. my fiancee has a lot of problems with her mother and would like to have as little contact with her as possible. now, my fiancee is still covered under her moms health insurance and will be until she's 23 (shes currently 21). they have Blue Cross/Blue Shield. her mom lives in Pittsburgh and she lives with me in OH. her mom tells her that she has to see doctors and go to hospitals in PA, and i think she could see them where we live in OH. does anyone know how this works, or wear i could find out more info?
i know this might be confusing and difficult, but any help at all would be appreciated.....

Child support is not intended to be cash given to the child. That wouldn't even happen if the biological parents stayed together. It is for their support...however the custodial parent sees fit to spend it. There are no laws governing how it's spent, except of course if she were buying crack with it. And then, the only thing that would happen is custody would be transferred, and the crack-parent would be ordered to pay support.
As for the health insurance, the issue is that all insurance companies have their providers they participate with. If the provider does not participate, the insurance will not pay. So, if Mom's BC/BS won't pay in Ohio, and your fiance gets treatment in Ohio, then your fiance will be paying his/her own medical bills (if over 18 ).

i understand what your saying, but the money was not used to support the child in this case. the child wasnt even living in the mother's home at the time.

Then perhaps the father would have a case-I don't know. But no way would the child be able to get the money.
