my name is on the birth certificate of a 7 year old child who is not mine, his bio. father is in his life, an affidavit was signed be me, before i found out that the child was conceived through an affair. we were not married, the mother went through the state for financial help, and the state is coming after me, i need to relinquish my rights and let the bio. father adopt him but dont know where to start or how this works or the costs. what can i do? the child and mother live in a different state. Any help or advice will be greatly appreciated. thank you.

in the states you can't. you still have to pay until the courts say you no longer have to.

unfortunatly, i have no advice. My husband is in the same situation. $736 a month goes to a child who is not his, and despite 3 dna tests, the courts still have not removed this order. in our case, they deemed him "best for the child" and appointed him father. again, all of this despite 3 dna tests, and us being 2000 miles away. We didn't pay for about a year, and as you can imagine $736/month adds up quickly, and almost went to jail. If we miss one more payment, off to jail he goes. Yes, all of this despite 3 dna tests.

If you're state-side, what state are you in? The only thing i can think of is to have the bio father adopt the boy, but i believe he will have to begin that process.

My sister has gone through something like this, but the bio. father doesn't want to be the father. She went to a lawyer and was told that there has to be someone in his spot willing to be the father, till then he can not sign over his rights. Also, if he misses payments of child support he goes to jail, and he has been there many times. (We live in the states as well..)

Wow... the system is really, really screwed up! Amber, I feel soooo bad for you and your husband, having to give $736 a month to some woman who is screwing you over. I don't know how you keep from going crazy! And the poor kid, too! Unfortunately I have no advice, either!
