Default Uk Child support question....

Hi,

New here

Is there anyone on here who understands the UK legal system, I would like some advice regarding my childs legalities with his father (Never married too).

I will start from the start.
my sons father and me split up for many reasons. he was violent and he was into drugs as well as never bothering with his son. when i left i said to him he could see his son whenever he wants and set it up at my mothers house. he turned up a few times and would leave for few months. he has not seen his son for over 4 months now and has returned. he has never asked how his child is the simple things that anyone would do.
I personally feel he is just trying to wind me up by harrassing me. he has had no interest in his child and now he has returned i have to apply for a residance order and a prohibited steps order, which stops her from taking his child out of the country, as he has threatened to take his child for me never to see.
I dont understand the court proceedings and cant afford a solicitor. can anyone help on what i need to do or what i need to avoid.

You can apply for financial help for a solicitor, you can find out how to apply from a solicitor, local OM.

Ok here's what happened in my situation. My situation was very similar to yours.

I offered supervised contact at a contact centre (they are free and your local social services can help you find one) Then he will have to take you to court for an unsupervised access. It will documented which times he didn't turn up and how he interacts with your son. Also you have no contact at all so no opportunity to wind you up.

It goes to court and there will be a duty cafcass office in the room. Just keep saying your not happy that he is safe to have his child alone and say you want him to have drug counselling & anger managerment. If he sticks to them and completes them then CafCass will issue a report to the court and will recommend what is to happen. If your not happy then say so and it will all go back to mediation

If you are benefits or earn on £15.000 a year your entitled to legal aid.

hi guys,
listened to what you said but ran into a big problem.
let me explain. i went to apply for residence order to say legally the child is staying with me plus a prohibited steps order which says the father cant take the child out of the country, seeing as he has said he would. that all will cost me £175. quite alot hey.
i need the address of the father but he wont give it to me and without it i cant serve him. the legal advice says that i can ask the judge to serve him at work then they can obtain the address later but in order to do that i have to make the application with a covering letter along with a fine. thing is if the judge says no i cant then i dont get my money back. very unfair i feel that i have to cough up that sort of money for the judge to maybe just say no. i dont know what else to do.
does anyone have any ideas of what i can do or how to get a judge to tell me if its worth me putting in the application and it wont be a waste?

Firstly does your child have a passport and does the father have it?

If you really concerned that he's going to take your child then why are you offering unsupervised access?

You can issue a statement to the court but you need evidence of things you say happened (anger or drugs) They might serve an interim order but they always get cafcass to do a report to access the situation more fully.

i have the passport and am trying to get the supervised contact centre but need referrals for that. i just dont know how to apply for the order without his address and loosing £175.
